Hajo Trade B.V., established and having its office in (7678AJ) Geesteren at the address Lutkeberg 61 (hereinafter referred to as: Hajo Trade), is the controller responsible for the processing of data as intended and referred to in this privacy statement.
Basis for processing – "Performance of a contract" Hajo Trade handles the purchase and sale, maintenance and repair of registered and non-registered motor vehicles, in particular quad and off-road vehicles.
This takes place on the basis of concluded (purchase) agreements. The provision of information by the customer, with the wish to – where possible – reach an agreement, can also be classified under this process.
In order to be able to handle these agreements, it is necessary for Hajo Trade to process data. This takes place on the basis of "performance of a contract".
The data processed in this context may relate to orders and/or businesses, but may also concern data on the basis of which individuals can be identified. This may, for example, include data such as:
Without this information, the correct order information cannot be linked to the correct relation and/or contact information, which means it is not possible for Hajo Trade to fulfil the agreements properly and/or to provide the customer with the correct information.
Basis for processing – "Legal obligation" In addition, on the basis of the fiscal record-keeping and retention obligation, it is necessary for Hajo Trade to store and retain the data belonging to the basic administration (including data relating to the accounts receivable and accounts payable administration) for a period of 7 years. Only by processing the aforementioned data does Hajo Trade consider itself able to comply with the fiscal obligation.
With regard to both of the bases mentioned above, Hajo Trade obtains this data during or for the purpose of a contact moment with a (potential) relation, whether or not via the website or showroom/workshop, by telephone contact, or through other (email) correspondence with Hajo Trade, where data is provided by this relation.
Where necessary, this data will be processed by Hajo Trade.
Marketing communications
With regard to marketing activities, Hajo Trade may deploy various parties and/or programs for, for example, the distribution of marketing communications. For instance, Hajo Trade uses social media, and newsletters may be sent automatically via software systems. Through these programs and parties, data is also processed, which may concern data on the basis of which individuals can be identified.
Without the use of these programs, it is not feasible for Hajo Trade to reach existing and new customers.
Before proceeding to the registration and processing of data for these marketing activities, the customer's consent is requested. This may, for example, be because the customer deliberately enters the information.
Cookies and analysis programs For marketing purposes, Hajo Trade may make use of (the placement of) cookies and programs for analysing the (cookie) data obtained. This enables Hajo Trade to conduct market research to a certain extent. The details of the cookies to be placed / placed can be found at the bottom of this document.
With analysis programs, it is possible to obtain information that may lead to the identification of any (natural) person. For this reason, this data also falls under the scope of the GDPR.

Reviews – WebwinkelKeur
We collect reviews via the WebwinkelKeur platform. If you leave a review via WebwinkelKeur, you are required to provide your name and email address. WebwinkelKeur shares this data with us, so that we can link the review to your order. WebwinkelKeur also publishes your name on its own website. In some cases, WebwinkelKeur may contact you to provide clarification of your review. In the event that we invite you to leave a review, we share your name and email address with WebwinkelKeur. They use this data solely for the purpose of inviting you to leave a review. WebwinkelKeur has taken appropriate technical and organisational measures to protect your personal data. WebwinkelKeur reserves the right to engage third parties for the purpose of providing its services, for which we have given WebwinkelKeur our consent. All the safeguards mentioned above regarding the protection of your personal data also apply to the parts of the service for which WebwinkelKeur engages third parties.
Other processing on the basis of "consent" In other cases in which Hajo Trade considers it necessary to process your data, and where there is no legal basis, Hajo Trade will request "consent".
Pursuant to fiscal legislation, Hajo Trade is obliged to retain data related to its accounts for 7 years.
Data obtained through the use of analysis programs is deleted no later than 50 months after registration. Hajo Trade considers this period reasonable, as it needs this time to act on the outcome of the market research and to adjust its product range and policy accordingly.
For the purpose of sending newsletters and/or similar marketing communications, the relation is free at any time to unsubscribe from receiving (and therefore also the sending of) marketing communications. Personal data is deleted within 2 months of unsubscribing from the systems involved in the sending of marketing communications.
At the bottom of this privacy statement you will find an overview of the cookies used and placed, together with the retention period per cookie.
(Personal) data not related to one of the options above is deleted within 12 months after the customer actively ends the customer relationship, or modified in such a way that the data can no longer be traced back to a specific natural person. The reason this only happens after active termination is that Hajo Trade considers it important to be able to retrieve historical data over time (sometimes even after several years), for example regarding a previous repair. If you wish for earlier deletion, you can always submit a request to that effect.
For good service and business operations, Hajo Trade is required to engage third parties.
Regarding business operations Hajo Trade makes use of the services and products of third parties. For example, an external accountant is used, as well as a party for website matters such as hosting and maintenance. Internally, Hajo Trade uses software for workshop / inventory and accounting. Software such as Microsoft Office 365 is also used.
These parties have (limited) access to the data of Hajo Trade's relations. Where necessary, Hajo Trade enters into a processor agreement with these parties to regulate the protection and use of this data.
Regarding marketing activities As described earlier, Hajo Trade may deploy businesses and/or cookies and/or programs for marketing activities.
These parties may, after use, deploy data already collected and/or data obtained for purposes including market research and the improvement of the website / product range and services. Where necessary, Hajo Trade enters into a processor agreement with these parties to regulate the protection and use of this data.
Other third parties Without the consent of Hajo Trade's relation, no data is shared with other third parties. The only exception is where Hajo Trade is (urgently) advised or obliged to do so on the basis of a legal provision.
For the use of programs / parties, Hajo Trade conducts research and/or seeks advice from third parties, such as its accountant or its internet marketing agency. If this results in the advice to have the data processed by a party outside the EU, a specific processor agreement will be entered into with that party where necessary.
Hajo Trade ensures organisational and technical measures to secure (personal) data. For instance, attention is paid, among other things, to securing the data received after use of the website, as well as to limiting access to Hajo Trade's systems.
This privacy statement does not apply to third-party websites connected to Hajo Trade by means of links (or otherwise). Hajo Trade cannot guarantee that these parties handle (personal) data in the desired manner. Right of access You have the right to access the data that Hajo Trade has available about you.
Right to rectification, restriction and erasure You also have the right to have the data that Hajo Trade has available about you corrected, supplemented or erased in its entirety.
With regard to the erasure of data, Hajo Trade must comply with the retention obligation imposed on it by law. Hajo Trade therefore cannot avoid retaining the data covered by this retention obligation. All (any) other data is – following an explicit request from you – erased from Hajo Trade's systems.
You also have the right to restriction of the processing of your personal data. This means that Hajo Trade will retain your data but will no longer use it further. This may be the case in several situations. An example is impending legal proceedings for which you may need the data. If you believe you are entitled to the right of restriction, you are requested to contact Hajo Trade.
